ANYWEAR.PL ONLINE STORE TERMS AND CONDITIONS

These Terms and Conditions govern the online sale of Goods offered through the anywear.pl online store. The anywear.pl online store sells Goods within Poland and across Europe via the Internet on the anywear.pl website.

DEFINITIONS AND GENERAL PROVISIONS

  1. Seller – The owner of the anywear.pl online store and personal data administrator: Anywear Patryk Brdej NIP: 7343465506, REGON: 523062329.
  2. Buyer – a natural person, legal entity, or organizational unit without legal personality, who has an email account and possesses legal capacity to perform legal acts in accordance with the law.
  3. Consumer – any natural person purchasing Goods in the anywear.pl store within the meaning of Article 22¹ of the Civil Code. Liability for warranty claims regarding physical and legal defects of the Goods is excluded for persons and entities conducting business activities (entrepreneurs).
  4. Order – a declaration of will by the Buyer, submitted using the order form available on the anywear.pl website, and directly aiming to conclude a distance sales contract for Goods with the Seller.
  5. Goods – textile products intended for sale, placed on the anywear.pl online store website.
  6. Placing an order through the anywear.pl online store is only possible after the Buyer has simultaneously accepted the provisions of these Terms and Conditions and the Information Clause regarding personal data processing.

PLACING AND FULFILLING ORDERS

  1. A condition for placing and fulfilling an order through the anywear.pl online store is for the Buyer to create an account on the anywear.pl store website. Creating an account in the anywear store requires the Buyer to provide the following personal data: name and surname, residential address, phone number, and email address. By ordering Goods, the Buyer confirms the truthfulness of the data provided.
  2. The agreement with the Buyer for creating an Account in the Store is concluded for an indefinite period.
  3. The Buyer may terminate the agreement for creating an Account in the anywear.pl online store at any time by sending a termination notice to the Seller’s address, as specified in point 1 of DEFINITIONS AND GENERAL PROVISIONS, or via email to: anywear.kontakt@gmail.com. The agreement will be terminated upon receipt of the notice by the Seller, and consequently, the Buyer’s account on the anywear.pl online store website will be immediately deleted.
  4. The Seller may terminate the agreement for creating an account in the anywear.pl online store only in the following situations:
  • the Seller ceasing to operate the Store,
  • the Buyer providing unlawful information in the registration form or Order form. In the case specified in point 4 of the Terms and Conditions, the agreement for creating an Account in the Store will be terminated after a one-week notice period.
  1. Each Order, immediately after being placed, is confirmed by anywear.pl via email to the address provided by the Buyer when creating an account in the anywear.pl store.
  2. Product information posted on the anywear.pl store website constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
  3. The Seller makes every effort to ensure that the photos of the Goods (especially their size and colors) posted on the anywear.pl online store website accurately reflect their appearance in reality.
  4. In case of unavailability of Goods, the Buyer will be informed by the Seller via email, to the address provided by the Buyer when creating an account in the anywear.pl store, and has the right to choose one of the following options:
  • cancellation of the placed Order
  • agreement to extend the Order fulfillment time by the number of days specified by the Seller,
  • partial fulfillment of the Order and refund of payment for the unfulfilled part of the Order.
  1. After choosing one of the options mentioned in point 5 above, the Buyer will immediately send a return email message to the Seller.
  2. The Order may be canceled by the Buyer no later than 24 hours from the moment the Buyer receives an email from the Seller regarding the unavailability of the Goods.
  3. If the Buyer chooses the option mentioned in point 8, item 3 above, the refund for the unfulfilled part of the Order will be made within 14 business days from the moment the Seller receives the return email from the Buyer, to the bank account from which the Order was paid by the Buyer.
  4. All prices of Goods are expressed in Polish Zloty and include VAT. The stated prices do not include shipping costs for the Goods.
  5. The Seller reserves the right to change the prices of Goods and shipping costs, to introduce and remove Goods from the offer, and to introduce and cancel promotional campaigns.

PAYMENT AND SHIPPING

  1. Payment for the placed Order is made via online transfer to the Seller’s bank account, through the Przelewy24 payment service.
  2. The Goods will be shipped to the Buyer within a maximum of 7 business days from the date the payment for the Order placed by the Buyer is credited to the Seller’s account.
  3. The Goods will be shipped to the Buyer via In Post parcel lockers or Courier, depending on the option chosen by the Buyer when placing the Order for the Goods.
  4. The shipping cost of the Goods is covered by the Buyer and depends on the chosen delivery method when placing the Order for the Goods.
  5. Along with the Goods, a fiscal receipt is provided, or upon the Buyer’s request (if such an option is selected when placing the Order), a VAT invoice.

RETURNS AND EXCHANGES

  1. The Buyer may withdraw from a distance sales contract without stating a reason within 14 days from the date of receiving the purchased Goods. To do this, a declaration of withdrawal from the sales contract should be sent using the appropriate form (an example template of the declaration of withdrawal from the sales contract can be found on the anywear.pl website in the TERMS AND CONDITIONS tab) or a handwritten declaration of withdrawal from the sales contract (including the Buyer’s name and surname, residential address, order number, and the bank account number to which the purchase costs are to be refunded), to the address: Anywear.pl ul.OSTRÓDZKA 98E , 03-289 Warszawa.
  2. Simultaneously with sending the withdrawal form from the sales contract, the Buyer should return the purchased Goods along with proof of purchase (fiscal receipt or VAT invoice) to the address mentioned above. 1.
  3. The refund of the purchase costs of the Goods (i.e., the purchase price and the shipping costs of the Goods to the Buyer up to the amount corresponding to the cheapest shipping option included in the Goods sales offer) is made exclusively to the Buyer’s bank account, within no more than 14 business days from the date the Seller receives the Goods along with the declaration of withdrawal from the sales contract.
  4. The cost of return shipping of the Goods to the Seller is covered by the Buyer, as the party withdrawing from the contract.
  5. The anywear.pl online store does not accept return shipments sent at the recipient’s expense or cash on delivery.
  6. The Buyer is liable for any diminished value of the returned Goods resulting from using them in a manner other than what was necessary to ascertain their nature, characteristics, and functioning.
  7. With the Seller’s consent, the Buyer may also exchange the Goods for other Goods within 14 days from the date of receiving them. In such a case, the Buyer should contact the Seller via email at: anywear.kontakt@gmail.com.
  8. When exchanging Goods, the Seller takes into account any price difference between the exchanged Goods and the Goods for which they are exchanged. The price difference for the aforementioned Goods is refunded to the Buyer’s account or paid to the Seller’s account within 7 business days from the Seller’s receipt of the return shipment containing the exchanged Goods. The shipping costs for Goods during an exchange are borne by the Buyer.

QUALITY GUARANTEE AND COMPLAINTS

  1. The Seller informs that they are obliged to deliver Goods free from physical and legal defects and provides the Buyer with a 24-month warranty for the purchased Goods.
  2. A complaint should be submitted in writing using a form, to the Seller’s address, as specified in point 1 of DEFINITIONS AND GENERAL PROVISIONS, or via email to the following address: anywear.kontakt@gmail.com. An example complaint form template can be found on the anywear.pl website in the TERMS AND CONDITIONS tab.
  3. The complaint should include the following Buyer’s data: name, surname, residential address, phone number, Order number, and a description of the event forming the basis of the complaint, the chosen type of Buyer’s request in connection with the damage or defect of the Goods (exchange of Goods, repair of Goods, refund of the purchase price of the complained Goods), and attach proof of purchase (receipt or VAT invoice – in electronic or printed form, depending on how the complaint is submitted), as well as the bank account number for the refund of the purchase price of the complained Goods (if this option is chosen by the Buyer).
  4. Complaints are processed within 14 calendar days from the date the Seller receives the complaint.
  5. The Buyer will be informed by the Seller about the acceptance or rejection of the complaint via email to the address provided when placing the Order in the anywear.pl online store.
  6. If the complaint regarding the Goods is accepted, the Buyer may demand repair of the Goods or exchange of the Goods for Goods free from defects. If the repair of the Goods or their exchange for Goods free from defects is impossible, or would involve excessive costs, or would cause significant inconvenience to the Buyer, the Buyer may withdraw from the sales contract – in which case the Buyer will receive a refund for the purchase of the complained Goods.
  7. The Buyer may also demand a suitable reduction in the price of the complained Goods if the complaint is accepted and if its non-conformity with the sales contract for the Goods is minor.
  8. The shipping costs of the Goods during the complaint procedure are covered by the Seller.
  9. If the complaint is rejected, the Goods will be sent back to the Buyer along with an opinion regarding the groundlessness of the complaint.

FINAL PROVISIONS

  1. All textual information and photos of Goods posted on the anywear.pl online store website are protected by copyright.
  2. The provisions of the Act of March 2, 2000, on the protection of certain consumer rights and liability for damage caused by a dangerous product, and the Act of July 27, 2002, on special conditions of consumer sales and amendments to the Civil Code, do not apply to Buyers other than Consumers, in particular, provisions regarding the right to withdraw from a sales contract and rights arising from the non-conformity of Goods with the contract.
  3. All trademarks and company names posted by the anywear.pl store are used solely for informational and advertising purposes and remain the property of their creators.
  4. Failure to accept the provisions of these Terms and Conditions via the website prevents the purchase of Goods offered by the Seller. The Buyer has the opportunity to review the Terms and Conditions when placing an order and at any time via the anywear.pl store website in the TERMS AND CONDITIONS tab. Buyers with their own account in the anywear.pl online store will be informed about changes to the Terms and Conditions via email. A Buyer who does not accept the changes introduced in the Terms and Conditions has the right to delete their account in the anywear.pl online store at any time.
  5. In matters not regulated by these Terms and Conditions, the provisions of the Civil Code and other acts shall apply.
  6. The Seller is not responsible for email server administrators blocking messages sent to the email address provided by the Buyer, or for email messages being deleted and blocked by software installed on the computer used by the Buyer;
  7. To the extent permitted by law, the Seller is not responsible for disruptions, including interruptions, in the functioning of the anywear.pl online store caused by force majeure, unlawful actions of third parties, or incompatibility of the anywear.pl online store with the Buyer’s technical infrastructure.
  8. These Terms and Conditions come into force on September 20, 2022, with effect from September 20, 2022.
